Changes to Texas Booster Seat Law

Effective September 1, 2009, a new law in the State of Texas will require even more children to be strapped into a booster seat when inside a motor vehicle. The new regulation will require children to use a booster seat until they are 8 years old or have reached a height of at least 4 feet 9 inches tall. This is a significant change from the current law which mandates booster seats for children until they are 5 years old or are at least 3 feet tall.

Violators of this new law will be fined $25 for the first offense and as much as $250 for additional offenses of this new law. These fines will take effect in June of 2010.

I had no idea of this development - Thanks for this notice. My six year old daughter is gonna pitch a fit, but far better this than a ticket.

This has been in the works for several months and it kind of got buried by other things that were happening. I kept following it until it passed and had an effective start date.

I haven't seen many 8 year olds that are almost 5 feet tall. It looks like they are going to have to use the safety seats till they get to be older(9 years at least). They're putting some stiff fines on non-compliance that need to be avoided. My 5 year old grandson isn’t going to like it either!

What a great law! The kids should actually enjoy sitting in the booster seat because it helps them see out of the window better. Just explain it to your child that way! I wish Florida had as much common sense.

I am glad to see this law. We make our daughter (almost 6) ride in a booster seat and all her friends don't have to. Will help avoid a few battles for Mommy now that its the law :)

It's going to save a lot of kids AND a few arguments as well. Plus there is going to be a requirement for all persons riding in a motor vehicle to have a seat belt on effective Sept. 1.

I have a 9 1/2 year old and she is still in a booster seat. She is a small 9 year old and I couldn't imagine what would happen to her if she wasn't in a car seat, she is much safer this way. I'm glad they passed this law, but regardless she still would of been in a booster seat. 5 years old was way to young in the first place and there is no way that seat belt could have fit them properly in the first place.
